CINCINNATI (AP) — Yadier Molina homered and drove in three runs, leading the St. Louis Cardinals to a 5-3 victory that deepened the Cincinnati Reds’ worst season-opening slump since 1955. St. Louis came into the series with a stagnant offense but broke out during the last two games against the worst pitching staff in the majors. The Reds have the worst record in the majors at 2-11.

KANSAS CITY, Mo. (AP) — Albert Pujols homered and drove in three runs, Ian Kinsler had three hits and a sacrifice fly that scored Shohei Ohtani with the go-ahead run in the eighth inning and the Los Angeles Angels rallied to beat the Kansas City Royals 5-4. The Angels have won six straight and nine of 10. Blake Wood (1-0) worked a spotless seventh to pick up the victory. Keynan Middleton pitched the ninth for his third save in as many opportunities.

KANSAS CITY, Mo. (AP) — Outfielder Tarik El-Abour, who was diagnosed with autism at age 3 and did not speak until he was 6, signed a minor league contract with the Kansas City Royals on Autism Awareness Day. El-Abour was assigned to the Royals’ extended spring training in Surprise, Arizona, and will open with one of Kansas City’s three rookie league clubs, which all start their seasons in June. The 25-year-old El-Abour has played in the independent Empire League, where he was named rookie of the year in 2016.

LINCOLN, Neb. (AP) — Nebraska quarterback Patrick O’Brien plans to transfer. Former coach Mike Riley recruited O’Brien to play in a pro-style offense. New coach Scott Frost has brought his spread-option offense with him from Central Florida. O’Brien played in three games as backup to Tanner Lee last season.

DES MOINES, Iowa (AP) — Democrats searching for potential presidential candidates may find some in an unlikely place: city hall. A handful of Democratic mayors from around the country are considering the race in 2020, taking early steps in Iowa, which holds the first major contest of the presidential campaign. Los Angeles Mayor Eric Garcetti plans to visit Iowa Friday in hopes that his experience running a big city and facing touchy issues like immigration might distinguish him.

DES MOINES, Iowa (AP) — The Iowa Supreme Court has dismissed the state’s efforts to confine two men convicted for sex abuse crimes indefinitely under the state’s law allowing civil commitment of sexually violent predators. The court concluded that Nicholas Wygle, of Aplington couldn’t be further held and concluded Ronald Tripp, of Hazleton should be released from civil commitment. The court says a high bar must be set for holding people after completion of prison sentences to avoid violating constitutional protections.

JEFFERSON, Iowa (AP) — An Iowa city is reviewing its animal control policies and suspending its practice of trapping and fatally shooting feral cats. City administrator Mike Palmer says Jefferson has had feral cat colonies for years. Palmer says the officers are trained to recognize when captured cats are wild and that the department kills about one cat a month. The city is looking to temporarily house up to 30 cats, pending the policy review.

Court: 2 convicted of sex crimes can’t be held indefinitely

News

April 13th, 2018 by Ric Hanson

DES MOINES, Iowa (AP) — The Iowa Supreme Court on Friday dismissed the state’s efforts to confine indefinitely two men convicted for sex abuse crimes under a state law allowing sexually-violent predators to be committed. The court concluded that 29-year old Nicholas Wygle, of Aplington, could not be further imprisoned because he had completed his two-year prison sentence for assault with intent to commit sexual abuse and was serving a special 10-year sentence in an Ames residential facility when the state began its civil commitment proceedings.

The court concluded state law only allows officials to commit sexual predators if they’re “presently confined” or if they commit another sex-related crime. Wygle had not committed another crime and the court concluded being in a residential facility is not the same as being presently confined. As a result, the court ordered the case dismiss and Wygle will not be held in the civil commitment program.

In a second case, 66-year old Ronald Tripp, of Hazleton, will be released from civil commitment after the court ruled his case should have been dismissed. The justices concluded the state lacked evidence to show Tripp committed another sex-related crime that justified civil commitment.

Both cases were decided by a split 4-3 decision. State civil commitment programs have been challenged in court cases that have reached the U.S. Supreme Court. There is a case currently scheduled for trial Oct. 1 in federal court in Cedar Rapids in which nine men claim the Iowa civil commitment program is unconstitutional because it fails to offer adequate counseling and other services that would rehabilitate them enough for release.

Court challenges to Iowa’s law enacted in 1998 highlight the difficult balance states must strike between keeping dangerous sexual predators off the streets and not violating their constitutional rights by imprisoning them longer than their court-mandated sentences.
