Toledo (IA) faced with yet another lawsuit over excessive force by police officers

News

February 3rd, 2024 by Ric Hanson

(Iowa Capital Dispatch) -A city in the east-central part of Iowa is facing a fourth federal lawsuit tied to the alleged actions of one former police officer. In 2023, City officials in Toledo publicly condemned one of its police officers, Kyle Howe, for multiple instances of excessive force. Howe resigned in the midst of an internal investigation that involved a review of various body-camera videos involving several individuals he had arrested.

In September 2023, two separate lawsuits were filed against Howe and the City of Toledo in U.S. District Court for the Northern District of Iowa, each alleging false arrest, assault, battery, negligent supervision and civil rights violations.

In November, a third lawsuit was filed in federal court on behalf of 72-year-old Steven Horrigan of Chelsea, alleging battery, excessive force, false arrest, assault and negligent supervision and training.

This past week, with those three lawsuits still pending, a fourth lawsuit was filed against Howe and the city.

The new case was filed on behalf of Cynthia McSweeney of Tama, who alleges that on March 12, 2022, Howe and fellow Toledo police officers Anthony Rodriguez went to her home to investigate an alleged theft by her son. After McSweeney observed her son being arrested, she allegedly asked Howe, “What if I would like to press charges against –,” at which point Howe allegedly cut her off, grabbed her right arm and told her, “You’re going to jail, too.”

The lawsuit claims Howe violently forced McSweeney to the ground, breaking her glasses and bruising her body. “Howe’s use of force was excessive, as Cynthia was not aggressive or resisting arrest,” the lawsuit alleges.

The lawsuit seeks unspecified damages for civil rights violations, false arrest, battery, assault, negligent supervision and training, and abuse of process.

Howe and the city have yet to file a response to the lawsuit.

Atlantic Basketball stumbles at home against Denison-Schleswig

Sports

February 2nd, 2024 by Asa Lucas

The Atlantic Trojan’s basketball team fought at home on senior night but fell short against the Denison-Schleswig Monarchs 57-51. The first quarter saw an electric performance from Nolan Waters hitting three triples to try and keep his team in the mix as they were down 15-11 after the first. In the second quarter Atlantic put on 12-2 run at the start of the second to take the lead for the first time during the night at 23-20. Denison-Schleswig then had multiple timely baskets to calmly answer Atlantic and take the lead into half time up 28-25.

In the third quarter both team’s offensive productions slowed down with the slew of foul’s being called. The Trojans got within six points of the Denison-Schleswig lead early in the fourth quarter, but the Monarchs would put together an 8-0 run to seize control of the game and ultimately win 57-51.

Atlantic Head Coach Dalton Franken said Nolan Water’s offensive production was impressive, but the rest of the team had too many breakdowns on the offensive end.

The Monarchs were led by 24 points from Lance Arkfeld and increase to 8-7 on the season. Luke Wiebers added 18 points on the night.

Atlantic was led by 20 points from Nolan Waters and Colton Rasmussen. The Trojans fall to 5-13 on the season and will now prep for a trip to Harlan on Tuesday to square off against the Cyclones. It is expected to be a physical matchup.

Tipoff is set for 7:30 p.m.

Atlantic Girl’s play through sluggish start to win at Home

Sports

February 2nd, 2024 by Asa Lucas

The Atlantic Girls basketball team carved out a 49-39 win at home on Friday night against the Denison-Schleswig Monarchs. The Trojans had a 9-2 first quarter lead melt away early in the second quarter but they responded thanks to 10 big points in the first half from Paytn Harter. Atlantic went into the locker room with 10+ turnovers and looked lethargic on the court. In the second half Atlantic clamped down defensively on the Monarchs and started the fourth quarter on a 10-2 run to grab the win. Trojan head coach Dan Vargason was proud with the overall effort from Atlantic in the second half.

It was a sturdy team effort for Atlantic with three players finishing in double figures. Paytn Harter led the Trojans again with 21 points. Makenna Schroeder added 11 points and Zoey Kirchhoff chipped in 11.

Atlantic improves to 8-12 on the season. Next up is a trip to Harlan on Tuesday and it’s a game where Vargason expects his team to be more aggressive.

Denison-Schleswig was led by 20 points from Kiana Schultz. The Monarchs drop to 8-9 and will face Carroll on Saturday afternoon.
