High Court rejects appeal in Iowa pollution case

WASHINGTON (AP) – The Supreme Court won’t hear an appeal from an Iowa grain company over a class-action lawsuit brought by nearby residents. The justices on Monday let stand an Iowa Supreme Court ruling that said residents could bring a nuisance lawsuit against Grain Processing Corp., which operates a corn processing plant in Muscatine.

The lawsuit accuses the company of routinely blanketing homes with soot and harmful chemicals. A lower court threw out the case, but the state supreme court said claims of nuisance, negligence and trespass are not barred by the federal Clean Air Act or related state rules governing air emissions.

Environmental groups backed the lawsuit, but business groups said regulation of air pollution should be left to state and federal agencies and not judges on a case-by-case basis.

RAYMOND LOUIS PETERSEN, 96, of Harlan, died Fri., Nov. 28th, at the Elm Crest Retirement Community, in Harlan. Funeral services for RAYMOND PETERSEN will be held 11-a.m. Wed., Dec. 3rd, at the Bethlehem Lutheran Church, in Jacksonville. Pauley-Jones Funeral Home in Harlan has the arrangements.

Visitation at the funeral home is from 4-to 9-pm Tue., (12/2), with the family greeting friends from 4-to 6-pm.

Burial will be in the Jacksonville Cemetery.

RAYMOND PETERSEN is survived by:

His daughters – Beverly Cox, and Marlene Wahl, of Omaha.

His son – Ron Petersen, of Harlan.

MARY BERNIECE MASUR, 78, of Harlan, died Fri., Nov. 28th, at Myrtue Medical Center in Harlan. A Mass of Christian Burial service for MARY MASUR will be held 10:30-a.m. Sat., Dec. 6th, at St. Michael’s Catholic Church, in Harlan. Pauley-Jones Funeral Home in Harlan has the arrangements.

The family will greet friends at the funeral home in Friday (12/5), from 5-to 8-pm. A Wake service will be held at the funeral home, beginning at 7-pm Friday.

Burial will be in the St. Patrick Cemetery at Neola.

Creston Police investigate 2 incidents of Theft

Police in Creston investigated two reported incidents of Theft on Thanksgiving Day. A resident in the 600 block of North Maple Street reported the theft of: a Rolex watch; miscellaneous jewelry; a black purse with rhinestones and chains, a driver’s license, credit, debit and Social Security cards. The theft occurred sometime between 10-a.m. and 10:30-a.m. on the 27th. The loss was estimated at $270

That same day, a resident on West Adams Street in Creston, reported someone entered his residence sometime between 2-p.m. Nov. 26th and 3-a.m. Nov. 27th. The resident was missing a 57 XBox One and  Xbox 360 games, a 32-inch Sanyo TV, an Xbox 360, and ZXbox One. The loss was estimated at $1,500.

Both incidents remain under investigation.

Creston man arrrested for being a felon with a firearm

The Creston Police Dept. today (Monday) released a report on arrests made over the past week. Officials say two people were arrested Sunday, including: 32-year old John Jacob Garcia, of Creston, who was arrested at his home for being a Felon in Possession of a Firearm. Garcia was being held in the Union County Jail on $5,000 bond; And, 21-year old Michael Dillon Johnson, of Grand River, was arrested Sunday at the Creston Wal-Mart, on a charge of Theft in the 5th degree. He was subsequently released after promising to appear later, in court.

Last Wednesday, Creston Police arrested 42-year old Clinton Ward Lovely, of Creston, on a warrant out of Union County for Criminal Mischief in the 2nd Degree, and Child Endangerment. Lovely was taken into custody at the Union County Law Enforcement Center, and later released on $5,000 bond. That same day, 37-year old Gerald Lynn Lawrence, Jr., of Des Moines, was arrested at the Union County Jail on a warrant charging him with a Probation Violation. Lawrence, Jr. was being held in the jail on $10,000 bond.

The Average High for the month of November in Atlantic, was 41. The Average Low was 18. The warmest day was on Nov. 5th when we reached 63-degrees. The lowest temp was 3 degrees on the 14th.

Snowfall for the month amounted to 3.9-inches, which, when melted and combined with the rainfall, totaled .45″ of liquid precipitation.  The largest amount of snow fell on Nov. 15th, when we received 2.5″.

Normal precipitation for the month is 1.85 inches. The normal Average High in November is 46 degrees, with the normal Average Low is 27.
