Cass County Jury finds Adair man to be a sexually violent predator

An eight-person jury in Atlantic deliberated for less than two-hours Wednesday afternoon before finding an Adair man to be a sexually violent predator. According to Cass County District Court documents, 52-year old David Charles Whetstone was remitted to the custody of the Director of the Department of Human Services, where he will be controlled, receive care and treatment for “His mental abnormality” until he is deemed safe for placement in a transitional release program, or discharged. The court made it clear his was a civil, and NOT a criminal, commitment.

Whetstone was immediately sent to the DHS Civil Commitment Unit for Sexual Offenders on the campus of the Cherokee Mental Health Institute, in Cherokee, where in addition to treatment, he will receive an annual medical examination of his mental state of being. The judge also said Whetstone must register as a sex offender before he is released from confinement, and submit a sample of his DNA to be kept on file. The sentence is subject to appeal.

In May 2008, Whetstone was found guilty of Assault with the Intent to Commit Sexual Abuse, an aggravated serious misdemeanor offense. The incident which led to his arrest and conviction occurred on April 4th, 2008. He was sentenced in August of that year to a two-year prison term. Prior to his release from prison and parole, the Iowa Attorney General’s Office filed a petition to have Whetstone committed, as an “extremely dangerous sexually violent predator.”

A little more than two-years earlier, Whetstone pled guilty to a charge of Disorderly Conduct, and was ordered to pay a $100 fine, following an incident which occurred between Whetstone and Greenfield Republican Representative Clel Baudler. Baulder told KJAN News in February 2006, that Whetstone had been harassing him for nearly a year, and had made veiled threats against his life.

Zola M. Krueger, 87, of Panora (formerly of Bagley) died Wednesday, September 21 at Iowa Methodist Medical Center in Des Moines.  Funeral services for Zola M. Krueger will be held on Saturday, September 24 at 11:00 am in the Panora Church of the Brethren.  Twigg Funeral Home in Panora has the arrangements.

Darlene Mary (Pedersen) Kay, 90, of Council Bluffs has died.   Funeral services for Darlene Mary (Pedersen) Kay will be held on Monday, September 26 at 10:00am in the United Church of Christ in Minden. Cutler-O’Neill-Meyer-Woodring Funeral Home in Council Bluffs has the arrangements.

Cardinals & Lance Berkman Agree To 1-Year Deal

ST. LOUIS, Mo., September 22, 2011 -St. Louis Cardinals Sr. Vice President/General Manager John Mozeliak announced today that the Cardinals have agreed to terms with outfielder/first baseman Lance
Berkman on a one-year contract for the 2012 season.  Financial terms of the deal were not disclosed.

Berkman, 35, has been a standout for the Cardinals this season, ranking among National League leaders in home runs (31), slugging pct. (.555), on-base pct. (.412) and batting average (.300), while playing a solid outfield.  Named an All-Star starter this year (his 6th selection), Berkman is batting .355 with runners in scoring position (ranking 2nd in the N.L.) and .394 during the Cardinals’ September charge.

“Lance proved to be everything we were looking for when we signed him last December,” stated Mozeliak.  “He’s an impact player who helped solidify our everyday lineup while also bringing a wealth of experience to our team.  We are excited to announce that he is going to remain a part of our team in 2012.”

The switch-hitting Berkman owns a career batting mark of .296 with 358 home runs and 1190 RBI in 1,767 games.  His career .409 on-base percentage is ranked 4th among active players and his .546 slugging mark is ranked 10th.    Berkman has placed among the N.L. top-10 in on-base pct. eight times and has finished among the league’s top-10 in batting on four occasions.  Berkman’s 358 career homers are 4th all-time among switch-hitters.

The six-time All-Star (2001-02, 2004, 2006, 2008 & 2011) holds the National League record for single-season RBI by a switch-hitter with 136 in 2006.  He’s had six seasons with 100 or more RBI and belted 25 or more home runs nine times, including a career best 45 in 2006.  His 31 home runs this season are just four shy of Rip Collins’ single-season (1934) club record of 35 by a switch-hitter.

The Cardinals announced a two-year contract extension thru 2013 for starting pitcher Chris Carpenter last week.

Iowan who tossed cat from window gets 2 years

COUNCIL BLUFFS, Iowa (AP) – A Council Bluffs man who told police that he performed a sex act on a cat and then threw it out of a seventh-floor window has been given two years in prison. Thirty-year-old Gerardo Martinez was arrested after officers  found the dead cat on a sidewalk outside a Council Bluffs apartment building on Aug. 3. Officers say Martinez was naked and told them he used methamphetamine and had had sex with the cat.

Court records say Martinez pleaded guilty last week to animal torture. A charge of beastiality was dropped. Martinez is a registered sex offender in Iowa. Online Iowa records say he was convicted in Pottawattamie County of sexual abuse of a girl age 13 or under in 1998.

Scammers try to take advantage of firefighter’s death

Authorities in Shelby County are warning about a scam being perpetrated on area residents following the death of a local firefighter. Officials with the Shelby Fire and Rescue Department have learned residents are receiving phone calls asking for donations, which the caller says will help the family of Shelby volunteer firefighter Mike Collins, of Minden, who was hit by a vehicle and killed Sunday night on Interstate 80, while assisting at the scene of an accident.

A telemarketing firm has been making phone calls to residents around the area, asking for donations to the “Mike Collins Fund.” When officials with the Shelby Fire and Rescue squad heard about the scam Wednesday, they issued an alert asking resident to hang up the phone if you receive such a call, and report it to the authorities.

The only legitimate fund for the family of Mike Collins is at the Shelby County State Bank, Shelby Branch. Officials say the bank will NOT call and ask for your donation. They will accept donations in person or by mail, at an address we provided you with earlier this week, here on KJAN. Iowa’s Archery Deer Hunting Season Begins October 1

One of Iowa’s most popular hunting seasons begins October 1st, when the archery deer hunting season opens. “We had over 57,000 bowhunters last year and I expect we will have a similar number this year,” said Tom Litchfield, state deer biologist for the Iowa Department of Natural Resources.  “Our herd is in good shape statewide, but hunters can expect to see fewer deer in most areas of the state.” Because of this, Litchfield said that while the antlerless quotas for all counties are unchanged from last year, hunters may need to refrain from shooting as many does as in past years especially in eastern Iowa. Hunters need to continue to work with landowners where deer numbers are still strong.

Iowa’s bow season attracts hunters who spend much of their time in tree stands often alone for hours at a time, so checking safety equipment is an important part of their hunting plan.  “Hunters should check all their gear to make sure it’s in proper working order, especially tree stands and safety harnesses,” Litchfield said.  “Hunters should always wear a safety harness and use caution when climbing. Falls associated with tree stand use are the most common hunting accidents during the bow season.”

Iowa’s bow season is Oct. 1st through Dec. 2nd, and then opens again Dec. 19th through Jan. 10th, 2012. Hunting hours are from one-half hour before sunrise to one-half hour after sunset. All deer taken must be reported using the harvest reporting system by midnight the day after the deer is recovered.  Accurately reporting the harvest is an important part of Iowa’s deer management program and plays a vital role in managing deer populations and future hunting opportunities.  For hunters with Internet access, the online harvest reporting is the easiest way to register the deer. Hunters can report their deer online at www.iowadnr.gov, by calling the toll free reporting number 1-800-771-4692, or at any license vendor.  

Additional Hunting Options

In addition to the bow season, many of Iowa’s urban areas and some state parks offer special hunts that bowhunters can participate in.  These hunts often have extra requirements so contact the organization listed in the hunting regulation brochure before going afield.
