Charges dropped in ‘stand your ground’ gunbattle case

DES MOINES, Iowa (AP) — Charges have been dismissed for a man who unsuccessfully argued that Iowa’s “stand your ground” law should protect him from prosecution following a Cedar Rapids gunbattle.

Linn County prosecutor Monica Slaughter requested the dismissal Wednesday of attempted murder and other charges filed against Michael Hodges Jr. Court records don’t explain why she made the request. She and her boss, Linn County Attorney Jerry Vander Sanden, didn’t immediately return messages Thursday from The Associated Press.

Hodges and Zevon Johnson had both said the law passed last year made them immune from prosecution. Security video shows them exchanging gunfire Jan. 28 in downtown Cedar Rapids.

The law says a person doesn’t have to retreat before using deadly force if he or she thinks his or her life is being threatened.

On Monday a judge denied Hodges’ request to dismiss the charges.

Audit finds questionable spending at U of Iowa dental school

IOWA CITY, Iowa (AP) — A special state audit has identified more than $57,000 in improper and unsupported purchases made through the University of Iowa dental school.A report released Thursday says the audit covered transactions made Aug. 1, 2012, through Aug. 31, 2016, by a woman working as an administrative specialist for the Periodontics Department. The improper purchases included gift cards, clothing, shoes, computer equipment and accessories.

The report also says the woman, Amanda Shumaker, altered old invoices to make them agree with some of the improper purchases. A routine review in July 2016 turned up discrepancies in Shumaker’s purchasing records, and she was placed on leave effective Aug. 1, 2016.

The report says the 34-year-old died less than three weeks later. An obituary says Shumaker died at a Davenport hospital.

The Iowa High School Athletic Association has released the 2018 State Baseball pairing for Class 3A and 4A. In Class 3A Harlan is the #2 seed and will take on 7th-seeded Boone in the Quarterfinals on Tuesday, July 24th at 7:30pm at Principal Park in Des Moines. Discharge into wetlands near Whiting identified and corrected

WHITING, Iowa – A mysterious clay tile line that was discharging into the McCandles – Cleghorn ditch and reported to the DNR on Friday, July 13 has since been identified.

After dye testing, using a camera in the unknown line, and dirt work, it was determined that a 10-inch clay tile line had collapsed under the city of Whiting’s wetland.  The tile was likely installed in the mid 1900’s and had been abandoned.  The tile was exposed and then removed.  At the end of the exposed tile, a 10-inch air bladder was installed to cap off the line.  Clay was then added to fill in the area near the capped tile line.

Now that the discharge has been stopped, the City of Whiting is working to restore the wetland to the originally designed standards.

Creston Police report two arrests in past day

The Creston Police Department reports two arrests in the past 24-hours.

On Wednesday afternoon Officers arrested 32-year-old Jose Manuel Huerta of Prescott on a Union County Warrant for Failure to Appear on the original charge of Theft 5th Degree. Huerta was arrested at 3:15pm at the Law Enforcement Center. He was booked in at the Union County Jail on $300 bond.

Early Thursday morning at 1:01am Creston Police arrested 59-year-old Steven Michael Nutt of Creston for Driving While Suspended. Nutt was arrested at Fremont and Maple Street in Creston. He was booked in to the Union County Jail on $300 bond.

Two recent drug arrests in Pottawattamie County

The Pottawattamie County Sheriff’s Office reports two men were arrested on drug charges Tuesday and Wednesday.

On Wednesday morning 20-year-old Fernando Madrigal of San Francisco, California was arrested after Deputies were called to the 23-mile marker of Interstate 80 to check an erratic driver. Madrigal was located and arrested for Possession of a Controlled Substance with Intent to Deliver and No Drug Tax Stamp. Deputies seized five pounds of marijuana during the stop.

Deputies also report the arrest Tuesday of 30-year-old Marcus Heye of Omaha, NE for Possession of Drug Paraphernalia. During investigation of a suspicious vehicle on Lake Hill Lane, Heye was found to be a passenger in the vehicle. Three pipes were seized from the vehicle. Heye was cited and released at the scene.
