Attempted home invasion in Council Bluffs Tuesday night

The Council Bluffs Police Department responded to a call of a possible home invasion on Tuesday at 9:49pm at 800 North 35th Street in Council Bluffs.  Upon arrival officers found the victim 33-year-old Charles Hernandez at a near-by location while officers secured his apartment.  Hernandez stated that he had entered the apartment at 9:30pm when he was confronted by a male suspect that had entered through the unlocked patio door.  The man pointed a black semi-automatic pistol at Hernandez and told him to freeze.  Hernandez then dove through the closed window from his middle floor apartment and ran from the scene to escape.

The suspect fled the scene and is described as a black male, 5’8″ tall, 180 pounds, wearing light colored shoes and white shirt.  At this time it is unknown if the suspect removed anything from the apartment.

Atlantic City Council to discuss potential appointment of Brink to At-Large seat

The Atlantic City Council this (Wednesday) evening will discuss filling the vacant At-Large seat on the Council. Their meeting begins at 5:30 in the Council’s Chambers, at City Hall.

Tuesday evening, the City’s Personnel and Finance Committee interviewed applicants for the seat in a closed session, and concluded when the open session resumed, that longtime Atlantic businessman Gerald Brink would be their recommendation to the Council. Four people had applied for the At Large Council seat. Three of them were interviewed Tuesday. If the Council eventually approves Brink’s appointment, the public will have 14 days to file a petition requesting a Special Election to fill the seat, which became vacant by the resignation of Bob Cord, who has moved to Des Moines.

In other business, the Atlantic City Council will recognize the Atlantic Trojan Softball Team for their performance this season and making it to the State Softball Tournament. The team was first organized in 1972. At that time, current City Clerk Deb Wheatley-Field was the Co-Captain. The Summer of 2016 was the first time in the 44-year history of the team, that they made it to the State Championship.

The Council will also act on a Resolution approving the Fiscal Year 2016 Financial Report (as required by Iowa Code), and a Resolution authorizing the bids for the Bull Creek Culvert replacement project. The location of the repair is southeast of the 8th and Walnut Street intersection, where a large portion of the ground has collapsed, posing a hazard to people and vehicles in the alley. The cost estimates exceed $200,000, and will be paid for from the bond fund issued for the Bull Creek project.

Near the end of the meeting, the Atlantic City Council will discuss pets and livestock within City Limits, with regard to pot-bellied pigs, and, City Administrator John Lund will present his “Multi-residential Rollback Impact” report, with regard to the new multi-residential property class on the City’s budget.

DES MOINES, Iowa (AP) — The board that oversees Iowa’s three public universities has responded to an inquiry from some state lawmakers about the search for a new president at the University of Northern Iowa. Katie Mulholland, president pro tem of the Iowa Board of Regents, sent a letter Tuesday addressing Sens. Rob Hogg, Jeff Danielson and Brian Schoenjahn. The letter details the timeline for hiring a president to formally replace Bill Ruud at the Cedar Falls school.

DES MOINES, Iowa (AP) — As work progresses on an oil pipeline crossing Iowa opponents are holding protest rallies and taking the state utilities regulators to court in hopes of stopping construction. A hearing is scheduled for Friday in Des Moines on a motion to stay construction on several parcels of land.

IOWA CITY, Iowa (AP) — An arbitrator has been suspended for an error-filled ruling that upheld the firing of a judge who testified against Gov. Terry Branstad’s administration. The Iowa Public Employment Relations Board says John L. Sandy will be suspended for six months. The discipline stems from Sandy’s ruling upholding the firing of Administrative Law Judge Susan Ackerman.

BISMARCK, N.D. (AP) — A federal judge is ordering protesters in North Dakota not to interfere with the construction of a $3.8 billion, four-state oil pipeline. U.S. District Court Judge Daniel Hovland granted the developer’s motion for a temporary restraining order Tuesday. The pipeline would go from North Dakota across South Dakota and Iowa to Illinois.

Lenox woman arrested on Meth & child endangerment charges

Fremont County Sheriff Kevin Aistrope reports officers with the Shenandoah Police Department stopped a vehicle near the intersection of Highway 59 and Airport Road Monday, for an equipment violation, and ended-up arresting the driver of the vehicle, 41-year old Christie Larson, of Lenox, on several drug, and other charges.

During the investigation, deputies with the Fremont County Sheriff’s Office K9 Unit deployed a narcotics K9 on the vehicle and discovered methamphetamine and marijuana inside the vehicle.

Larson was arrested for Possession of a Controlled Substance with the Intent to Deliver/Methamphetamine, Driving Under Suspension, Possession of Drug Paraphernalia, Possession of Marijuana, and Child Endangerment.

She was being held at the Fremont County Jail on $53,735 bond.

Gas station robbery in Council Bluffs Tuesday evening

Police in Council Bluffs are asking for your help in identifying the suspect involved a robbery Tuesday evening. Authorities say Darrah’s gas and service station at 3607 9th Avenue, was robbed at around 5:50-p.m. by a stocky black male, about 6-feet tall, in his late teens to early 30’s. The man had a black mask covering his face, and wore a gray hooded sweatshirt with dark pants.

The suspect fled the area in a red Chevy Impala parked south of the gas station, prior to officer’s arrival.

Another suspect was waiting in the vehicle. The second suspect was described as being a black male in his late teen to early twenties with a medium build.

The cashier on duty at the time stated that the main suspect entered the business with his hood up and stood in line with several other patrons before walking back to the beer cooler. The suspect then returned to the register and pointed a black semi auto pistol at the cashier and demanded all the monies in the cash drawer.

The suspect fled the business with an undetermined amount of monies as well as several cans of alcoholic beverages.  At this time the Criminal Investigation Division is continuing their investigation into this incident. Judge tells 18-year-old to carry picture of crash victim

COUNCIL BLUFFS, Iowa (AP) — An 18-year-old who pleaded guilty to vehicular homicide in a Neola crash has been has been ordered to carry a photo of the boy who was killed. The Daily Nonpareil reports that Kael Karagianis was sentenced Monday to five years of probation after receiving a deferred judgment. Under a deferred judgment, the conviction can be wiped from Karagianis’ record if he successfully completes the terms of his probation.

Those terms include carrying a photo of 14-year-old Gage Williams, who died March 21. Authorities say Williams and another teen were sitting in the truck bed when Karagianis lost control of the truck as he intentionally swerved and hit the brakes.

The terms also include community service and making two presentations a year on the dangers of reckless driving.

Atlantic Parks and Rec approves trail bid at Monday meeting

The Atlantic Parks and Recreation Department Board met Monday night at the City Hall Council Chambers.  During their meeting the board approved a bid contract with Howrey Construction for the Shildberg Recreation Area Lake 2 Trail for $109,000, which was the low bid.  The late start date for construction on the trail surrounding lake 2 will be September 19th.

Atlantic Parks and Rec Director Seth Staashelm also shared some concepts he had received for the possible Sunnyside Pool renovation.  A committee is scheduled to meet on the potential project on August 24th at 5:30pm.  In other pool news the last day that Sunnyside Pool will be open is Wednesday, August 17th and there will be a Doggie Dip day on the 18th from 2:00pm-4:00pm.

The board also discussed the Harl-Holt Basketball Court project, Trevor Fredrickson Field Renovation possibilities, and tree inspection forms that are available at City Hall for trees in the City right of way. Staashelm also informed the board that information and registration for Adult Men’s Flag Football will be going out soon.

The next regular meeting date for the Park and Rec Board will be on September 19th at 5:15pm at City Hall Council Chambers.

DOT officials see big jump in Iowa traffic fatalities

DES MOINES, Iowa (AP) – Transportation officials say there has been a spike in traffic fatalities in Iowa this year.

Data from the Iowa Department of Transportation show at least 238 traffic fatalities recorded in the state between the start of the year and the middle of August. There were 182 traffic fatalities during the same period last year.

Steve Gent, the department’s director of traffic and safety, says there’s been an increase in fatalities nearly every month of 2016. There’s no specific reason for the jump, though Gent notes more people are driving Iowa roads in part because the price of gasoline has decreased in recent years.

There have been roughly 320 traffic fatalities every year in Iowa between 2013 and 2015. Gent says the department expects this year’s final tally to top that.

Branstad named to ag advisory committee for Trump

DES MOINES, Iowa (AP) – Gov. Terry Branstad has been named to an agricultural advisory committee that will advise GOP presidential candidate Donald Trump.

The Trump campaign announced Tuesday that Branstad is part of a 64-member committee that will provide advice on the agricultural industry. It includes several governors and state lawmakers from around the country.

Iowa Secretary of Agriculture Bill Northey and Bruce Rastetter, president of the board that oversees Iowa’s three public universities, are also on the committee.

Media reports last week listed Branstad as a Trump adviser, and Branstad spokesman Ben Hammes reiterated that the position is unofficial and the Trump campaign isn’t paying the Republican governor.

Hammes says the committee will meet via phone, though Trump may also communicate one-on-one with Branstad, who has joined Trump at Iowa campaign stops.

The Mills County Sheriff’s Office released details Tuesday on multiple recent arrests.

On Thursday, August 11th deputies arrested 53-year-old John Michael Hudson of Hasting for Driving Under Suspension. He was arrested at 4:54pm at Harris Street and Platte Avenue.  He was held on $300 bond.

On Friday, August 12th on 195th Street at 1:58am deputies arrested 54-year-old Vickie Lynn Mayer of Council Bluffs for Possession of Controlled Substance and Possession of Drug Paraphernalia. Bond was set at 1,600.00. During the same incident deputies arrested 54-year-old Michael Allen Jackson of Carter Lake for Possession of Controlled Substance and Possession of Drug Paraphernalia  Bond was set at $1,300.

Also on Friday, August 12th at 1:56pm deputies arrested 63-year-old George Willis Adams of Malvern for Disorderly Conduct. Bond was set at $300.00.

On Saturday, August 13th at 9:54pm deputies arrested 39-year-old Lance Allen Cole of Glenwood, IA for OWI 1st offense on 230th Street. Bond was set at $1,000.

On Sunday, August 14th at 2:05am deputies arrested 45-year-old Troy Robert McCain of Carter Lake Driving Under Suspension at 315th and Janke Avenue. Bond was set at $300.

On Monday, August 15th at 11:16pm Sheriff’s deputies arrested 35-year-old Melissa Ann Elwood of Glenwood for Disorderly Conduct. She was held on $300 bond.

And on Tuesday, August 16th at 3:22am deputies arrested 35-year-old Daniel Lee Mattox of Shenandoah for Possession of Drug Paraphernalia on Highway 275 and Quigg Avenue. Bond was set at $300.
