Bluffs man on probation for a drug charge allegedly assaulted a 64-year old woman

News

December 18th, 2015 by Ric Hanson

A Council Bluffs man is back in prison after, among other things, allegedly breaking a rib of an 64-year-old woman. Bluffs Police told the Daily Nonpareil, 20-year old Alec Robey was arrested on Wednesday night and charged with aggravated assault, a misdemeanor, and felony counts of assault causing willful injury and second-degree criminal mischief. The willful injury and criminal mischief charges are Class D felonies and each subject to up to five years in prison.

Police Sgt. Chad Meyers said Robey got into a verbal altercation with the victim at her home on the 100 block of McKenzie Circle. During the altercation, Robey allegedly assaulted the woman, destroyed televisions and collectible china and caused damage to walls. The damage amounted to $2,000.

Robey remains in custody at Pottawattamie County Jail with bond set at $7,500. Wednesday’s arrest was Robey’s second in four months. On Sept. 1st, Robey was arrested at a Council Bluffs convenience store. When he was booked into corrections, staff allegedly found nearly three grams of methamphetamine in his shoe.

Robey spent eight days in jail before posting bond. On Dec. 1st, he was sentenced to one year in prison, but, as part of a plea, all but eight days were suspended, and he was placed on probation for one year. So far, the State of Iowa has not charged Robey with violating his probation.

S.W. IA man pleads guilty in assisted suicide case

News

December 18th, 2015 by Ric Hanson

A southwest Iowa man charged with assisted suicide in the death of a female companion in 2014 pleaded guilty this week. The Daily NonPareil reports a court order signed Monday, states 59-year old James A. Zingg was given a suspended 10-year prison sentence and two years of probation. Zingg pleaded guilty to a charge of assisted suicide in connection with the death of 47-year old Gwendolyn N. Melloway, in January 2014.

Zingg was prosecuted under a seldom-used Iowa law that dates to 1996. The law makes it a felony if someone “intentionally or knowingly assists, solicits or incites” another person to commit or attempt to commit suicide. Nebraska has a similar law on its books.

Officials said Melloway died on Jan. 21, 2014, two days after making a suicide pact with Zingg, then ingesting a lethal cocktail of pills. Zingg also took pills but did not die. Zingg, in a telephone interview later that year, disputed the characterization, saying it was Melloway’s idea to swallow pills, and he went along with it.

The Iowa Medical Examiner’s Office ruled her death a suicide caused by an acute drug overdose. After an investigation, Zingg was arrested in June 2014.

Iowa Medicaid privatization plan halted for 2 months

News

December 17th, 2015 by Ric Hanson

DES MOINES, Iowa (AP) — Federal officials called for a two-month delay in Iowa’s switch to a private Medicaid program but signaled the state likely will get approval to make the change. The federal Centers for Medicare and Medicaid Services on Thursday ordered a halt until March 1 of plans to hand over management of the $4.2 billion health care program for 560,000 poor and disabled residents to for-profit insurance companies.

Iowa Gov. Terry Branstad had planned to make the switch beginning Jan. 1. Branstad surprised the medical community and lawmakers last January with the plan he says will save $47 million in the first six months. Federal regulators told state officials Iowa needs more time but that approval is anticipated once the state is ready for a seamless transition that will not disrupt care.
