Legal dispute over Prairie Rose Casino continues

(Radio Iowa) — Lawyers for the States of Iowa and Nebraska as well as the City of Council Bluffs have filed an appeal to try to shut down the Native American casino in Carter Lake. The Ponca tribe opened the Prairie Rose Casino late last year after getting approval from the National Indian Gaming Commission. In mid-August, a federal judge said she would not overturn the commission’s decision.

Iowa, Nebraska and Council Bluffs are now appealing to a federal circuit court in St. Louis. The legal dispute over the casino project has been going on for more than a decade. The Prairie Rose casino is about five miles from the three state-licensed casinos in Council Bluffs and about two miles from downtown Omaha.

4 wheeler reported stolen from Greenfield

The Greenfield Police Department reports a 4-wheel ATV was stolen from the True Value Store in Greenfield, sometime last Friday night or early Saturday morning. The red ATV was described as being an off brand, and is missing the tail light cover. Please call the Greenfield Police Department at 641-743-2323 if you have any information on the location of it.

Update: Body of Missouri man found in Nishnabotna River in Fremont County

The Fremont County Sheriff’s Office reports that at around 9:17-a.m. today (Wednesday), they were notified that a body was located in the Nishnabota River, near the Goldenrod Boat Access, near Hamburg, Iowa. The body of 77-year old Thomas Gibson, of Watson, Missouri was located by family members in the river. The body was recovered with the assistance of the Missouri State Highway Patrol, Water Division, the Iowa Department of Natural Resources, and Hamburg Rescue. An autopsy will be conducted that the Iowa Office of the State Medical Examiner in Ankeny.

Mr. Gibson was reported missing by family members Monday, after finding his vehicle on the boat ramp at the Goldenrod Boat Access and his unoccupied boat near the Interstate 29 bridge over the West Nishnabota River. Numerous agencies and private individuals assisted in the search for Gibson.

Minnesota man admits leaving harassing notes on women’s cars

AMES, Iowa (AP) — A Minnesota man who left sexually-explicit notes on women’s cars in Ames has pleaded guilty in the case and will pay about $200 in fines. Des Moines station KCCI reports the 39-year-old David Cheney, of Rochester, Minnesota, was arrested in May after police received reports of the notes being left on cars in the parking lots of several retail stores. Police say the notes were specific to the women who found them and noted what the women were wearing.

Cheney was initially charged with seven counts of misdemeanor harassment. Court documents show that in a deal with prosecutors, Cheney pleaded guilty to three counts and received a 30-day suspended jail sentence, a year of probation and a $65 fine for each count.

ANKENY, IA. (August 28, 2019) – Casey’s General Stores is introducing its new Midwest Mystery Pizza which will be available to order on September 1. As the name implies, the new specialty pizza features a tasty combination of Midwest-inspired ingredients including pulled pork, bacon, Sweet Baby Ray’s® BBQ sauce, and fire-roasted corn.

Earlier in August, Casey’s launched a social media campaign asking fans to guess what ingredients might be on the new Midwest Mystery pie to which there were hundreds of guesses. Additionally, because Midwest Mystery is only a temporary name, starting September 1, fans will be able to enter the Name-Our-Pizza contest – whoever suggests the winning name will receive free Casey’s pizza for a year.

The Name-Our-Pizza Contest will start on September 1 and end on September 14. Entrants will submit their name suggestion via caseys.com. From those, three names will be selected and then put out for the public to vote September 16-22. The winning name will be announced on September 28.

2-vehicle accident in Atlantic – minor injuries reported

A 21-year old female was complaining of minor injuries following a two-vehicle accident at around 11:25-a.m. today (Wednesday), in Atlantic. The collision happened at west 6th and Cedar Streets. Authorities say a passenger car was traveling east on W. 6th Street and approaching Cedar, when an SUV traveling in the 500 block of Cedar pulled out and struck the front of the car.

The car was occupied by three people, one of whom was transported to the Cass County Memorial Hospital. No other injuries were reported.

The Union County Sheriff’s Office reports 36-year old Luke Allan Mullen, of Carbon, was arrested at around 9:30-a.m. Tuesday, on two Union County warrants for failure to appear. Mullen was being held in the Union County Jail on $1,300 bond.

And, a Lorimor woman reported Tuesday night, that sometime that afternoon, someone entered her 1999 Mercury Mystique while it was parked at her residence. A radio/cd player and a pair of girls Nike black shoes were taken from the vehicle. The loss was estimated at $175.

Body of W. Nishnabotna River boater found this morning

The body of a boater missing since late Monday afternoon in Fremont County was located this (Wednesday) morning. According to reports, the body was discovered at around 10-a.m. The victim’s name has not yet been released. The man’s unoccupied boat had been found Monday about one-mile down stream from the West Nishnabotna river’s Goldenrod Boat Access, east of Hamburg.

Crews had searched the river through late Monday night and all day Tuesday, before resuming their search this morning. Additional information concerning the location of the body was not immediately released.

City of Atlantic to check on overgrown trees – will issue notice to property owners if non-compliant

The City of Atlantic will be checking trees to see if they need trimmed. Officials say those that need to trim their trees over sidewalks, street, & allies will be notified by mail via a post card will be given 7 days to correct the issue by trimming their trees above 7 feet over sidewalks & 14 feet over streets & allies. Please make sure your trees are in compliance with the ordinance.

Below you will find City Code of Ordinance 151.05 DUTY TO TRIM TREES….

151.05 DUTY TO TRIM TREES. The owner or agent of the abutting property shall keep the trees on, or overhanging the street, trimmed so that all branches will be at least fourteen (14) feet above the surface of the street and seven (7) feet above the sidewalks. If the abutting property owner fails to trim the trees, the City may serve notice on the abutting property owner requiring that such action be taken within five (5) days. If such action is not taken within that time, the City may perform the required action and assess the costs against the abutting property for collection in the same manner as a property tax.

IA Man charged in theft of artifacts from Michigan museum

MUSKEGON, Mich. (AP) — A 61-year-old man has been charged in the theft of artifacts from a western Michigan museum that’s housed on a World War II-era warship.
Muskegon County Prosecutor D.J. Hilson says John Anthony Zaputil is named in a warrant this week charging him with larceny. Hilson said Zaputil is from Iowa, but had been staying at a Muskegon-area hotel in recent months.

Zaputil declined to comment, citing the advice of an attorney. The Muskegon Chronicle reports Zaputil is a licensed osteopathic physician in Michigan. Police have said about a dozen items were taken Aug. 3 from the USS LST 393 Veterans Museum in Muskegon, including medals, a shoulder patch and lapel pins. Hilson says they weren’t immediately recovered. WOOD-TV reports a surveillance photo helped lead investigators to Zaputil.
