New trial requested for man found guilty in fatal Audubon County accident

News

July 8th, 2013 by Ric Hanson

Attorneys for a southern Iowa man who was found guilty on charges associated with a 2011 fatal accident in Audubon County have asked for a new trial. The motion was filed Friday in the case against 57-year old Kendall L. Ware, of Lineville. Late last May, a jury found Ware guilty on felony charges of Vehicular Homicide/OWI and Serious Injury by Vehicle, in connection with an October 19th, 2011 accident on Highway 71 north of Brayton, that claimed the life of 17-year old Kristopher Crawley, of Hamlin, and injured three other persons. An investigation determined Ware had a blood alcohol content of more than two-and-half times the legal limit.

Sentencing is scheduled to take place at 10-a.m. in Audubon County District Court. Ware faces a maximum time in prison of 30-years on the combined charges, and fines of anywhere from $750 to $7,500 for the Serious Injury by vehicle charge, plus court costs and attorney’s fees.
