Man sentenced in NE on sex abuse charges returns to IA to face additional charges

A Council Bluffs man who in August was sentenced to up to 40 years in Nebraska prison after being convicted of sexual abuse returned home this week to face similar charges in Iowa. The Daily NonPareil reports 29-year old Rocky Ontiveros, was transported from the Diagnostic and Evaluation Center in Lincoln, Nebraska, to the Pottawattamie County Jail Tuesday evening, to face two charges of second-degree sexual abuse with a minor.

Before being brought to Pott. County, Ontiveros was serving a 30- to 40-year sentence in Nebraska after pleading guilty to first-degree sexual assault of a minor between the years of 2003 to 2009. He is eligible for parole in Nebraska on Sept. 12th, 2029.

Although Ontiveros will be off the streets for at least the next 14 years, Pottawattamie County attorney Matthew Wilber brought Ontiveros to Council Bluffs so that the two alleged victims could have their day in court – just like the single victim from Douglas County did when Ontiveros was sentenced on Aug. 12th. Ontiveros was officially charged by the Pottawattamie County Attorney’s office with two counts of second-degree sexual abuse back on Oct. 21st, 2014.

At that time, Ontiveros was awaiting trial for Douglas County charges in the Douglas County Corrections facility in Omaha. According to court documents, two days after Ontiveros was sentenced in Nebraska, the Pottawattamie County Attorney’s Office filed a detainer to bring Ontiveros to Council Bluffs. According to Iowa court documents, Ontiveros sexually abused two minors from Nov. 1st, 2013 to Sept. 19th, 2014, one of which was a relative. Ontiveros has been charged with two Class B felonies – which, according to Iowa law, means the victims were under the age of 12. If convicted, he could receive up to 25 years in prison.
